Production BRIEF
A brief provides guidelines for the copywriter – very helpful when writing the script for your commercial. Based on it, our creative department will prepare the text of the spot.
Terms and Conditions
- 01The basis for starting a recording is agreeing on the price with RPM and sending a completed production order form, or signing a cooperation agreement.
- 02The text to be recorded should be sent by email. The message should include information about the choice of voice talent and interpretation guidelines (phonetic pronunciation of foreign words, abbreviations and characteristic terms). For subscription services, orders are placed via the dedicated voiceplan.rpm.pl service.
- 03Recording delivery times are agreed individually in each case and depend on the choice of voice talent, the technical complexity, and the length of the material.
- 04Corrections resulting from RPM's fault are free of charge, while substantive corrections made after the recording are chargeable (e.g. change of text, voice talent, etc.). Their cost depends on the voice talent chosen and the technical complexity of the material being corrected.
- 05For advertising spots – if the production has not been accepted – changing the music is free of charge (if the proposed music for the production is rejected several times, the client is directed to the online music system where they can select the music themselves).
- 06The material is sent to the client by email in mp3 format (sound spots) and wav format (voice-over recordings). Converting the sound to other formats or splitting it into separate files requires additional arrangements. For subscription services, the recording is delivered via the dedicated voiceplan.rpm.pl service.
- 07The standard rights period for using the sound in media is 1 year; for phone announcements – no time limit; for multimedia presentations – no time limit; other forms and extensions – prices set individually.
- 08The prices given in the price list apply to a recording of one commercial up to 60 seconds long. For presentations/videos – where prices depend on the number of pages, one page is understood as one A4 page of 1,800 characters excluding spaces. Longer and non-standard recordings – prices set individually. The prices shown on the website are net values and do not constitute an offer within the meaning of the Civil Code.
- 09In case of any doubts regarding the valuation of material prepared for recording, RPM reserves the right to review it in order to precisely and finally determine its price.
- 10RPM has the right to refuse to accept material for production without giving a reason.
- 11RPM has the right to withdraw from a production (even while it is underway). In such a case, the client will not be charged any production costs. RPM is not liable for any losses caused by withdrawing from the production.
- 12If the client does not personally choose the voice talent taking part in the production (leaving the choice to RPM) and the material is not accepted, the cost of changing the voice talent is borne by the client.
- 13RPM is not liable for failure to deliver the material for reasons beyond RPM's control.
- 14RPM is not liable for the content of the production (such liability always rests with the client, regardless of the circumstances).
- 15RPM is not liable for the quality of work of voice talents from outside the RPM Voice Bank.
- 16The client undertakes to check and confirm receipt of the production within 3 business days of the production being sent (made available) by RPM. If no objections are raised within this period, this is deemed equivalent to acceptance and final receipt of the production. RPM bears no liability whatsoever for losses (cost of recording broadcast tapes, cost of a campaign, etc.) arising from the client's failure to check the accuracy of the recorded text/spot against the script.
- 17Objections to the production must be submitted in writing within 3 days of the sound being made available. Otherwise, RPM is not obliged to make any corrections.
- 18The client has the right to broadcast the sound as soon as it is received (before payment for the production), but is aware that failure to pay by the specified deadline may result in a financial penalty being imposed (as referred to in point 19).
- 19Failure to settle payment for the recording on time is equivalent to loss of the rights to distribute the sound (from the moment of its production). In the case of broadcasting or any other use of the sound without rights, the client may be subject to a penalty of up to 10 times the price of the ordered sound.
- 20In the event of non-payment, RPM will forward information about the debt (together with the penalty referred to in point 19) to the NATIONAL DEBT REGISTER / BIG, after which RPM will refer the matter for debt collection proceedings (at the debtor's expense).
- 21The client consents to the processing of their data for the purposes of performing the agreement and for archiving purposes.
- 22If required by the production process, the client consents to being contacted by phone.
- 23The client consents to the recording and archiving of phone calls during which important arrangements regarding the production are made.
- 24Orders can be paid: in cash (at the studio's premises) or by bank transfer. The method of payment must be agreed with the production engineer each time. For a first production or in the event of late payments, RPM reserves the right to request prepayment before starting the production.
- 25Complaints about a production should be submitted by email to: konrad@rpm.pl. The complaint handling period is 7 business days.
